Terms of Service

1. Acceptance of Terms

By accessing or using any Krimnizo Inc. service, including SS Ultimate and the associated dashboard at ssu.krimnizo.dev, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services. These terms form a legally binding agreement between you ("Customer") and Krimnizo Inc. ("Company", "we", "us").

2. Service Description

SS Ultimate is a professional Spotify streaming automation software platform provided as a subscription service. The service includes:

  • Access to a cloud-based automation dashboard
  • Pre-configured streaming infrastructure managed by Krimnizo
  • Technical support as specified in your subscription tier
  • Performance monitoring and analytics tools

Features, pricing tiers, and service specifications are described on our product pages and may be updated from time to time. We will provide reasonable notice of material changes.

3. Acceptable Use

You agree to use our service responsibly and in accordance with these terms. You must not:

  • Use the service for any illegal purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to other customers' accounts or our infrastructure
  • Resell, sublicense, or redistribute access to the service without our written consent
  • Use the service to transmit spam, malware, or harmful content
  • Reverse-engineer, decompile, or attempt to extract the source code of our software
  • Engage in activity that unreasonably burdens our infrastructure or disrupts service for other users

We reserve the right to suspend or terminate accounts that violate these terms without prior notice where immediate action is necessary to protect the service or other customers.

4. Payment Terms

All subscriptions are billed on a monthly basis, in advance. The following payment terms apply:

  • Payments are processed through Stripe in EUR
  • Subscriptions renew automatically unless cancelled before the renewal date
  • Prices are as published on our pricing page at the time of subscription and are subject to change with 30 days' notice
  • No refunds are issued after service activation. Once access to the dashboard has been provisioned, the subscription fee for that period is non-refundable
  • In the event of overdue payment, we reserve the right to suspend access until payment is received

5. Service Availability

We target a 99.8% monthly uptime Service Level Agreement (SLA) for SS Ultimate. The following conditions apply:

  • Uptime is measured on a calendar-month basis, excluding planned maintenance windows
  • Planned maintenance will be announced at least 24 hours in advance via our Discord server and dashboard notifications
  • Force majeure events (infrastructure outages outside our control, natural disasters, etc.) are excluded from SLA calculations
  • SLA credits may be issued at our discretion for material uptime failures; credits are applied to future billing periods and are not redeemable for cash

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Krimnizo Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service
  • Our total liability to you for any claim arising from these terms or the service shall not exceed the total amount paid by you in the 3 months preceding the claim
  • We do not guarantee any specific business results, revenue outcomes, or stream counts as a result of using our service

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such cases, our liability is limited to the fullest extent permitted by law.

7. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles. Any disputes arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands. If you are a consumer in another EU member state, mandatory consumer protection provisions of your country of residence may also apply.

8. Changes to Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes by posting the updated terms on our website and, where appropriate, by direct notification via email or Discord. Continued use of the service after the effective date of changes constitutes your acceptance of the revised terms. If you do not agree with material changes, you may cancel your subscription before the changes take effect.
